This Privacy Policy explains how Adstralia, Lda. (“Adstralia,” “we,” “us,” or “our”) collects, uses, shares, and protects your personal information when you use the Adstralia Platform. 1. Information We Collect.

1.1 Information Needed to Use the Adstralia Platform.

We collect information about you to provide, improve, and secure the Adstralia platform. Without certain information, we may not be able to deliver all services. This includes:

1.1.1 Account and Profile Information.

Such as your name, username, legal name, email, profile photo, gender, company or brand name (if applicable), and other details you choose to provide.

1.1.2 Payment Transaction Information.

Such as date and time, payment amount, payment instrument expiration date and billing address, Stripe account details, and other related transaction information necessary to process payments and payouts.

1.1.3 User-Generated Content.

Such as creative work, including photos, videos, text, or other content you submit to the Adstralia Platform.

1.1.4 Communications with Us.

Such as messages, chats, or emails sent to Adstralia for support, inquiries, or feedback.

1.1.5 Other Information You Provide.

Such as surveys, forms, participation in promotions, or optional demographic or professional information you choose to share.

1.2 Information Automatically Collected by Using the Adstralia Platform.

When you use the Adstralia Platform, we automatically collect certain information. This may include:

1.2.1 Usage Information.

Such as searches for Content, transactions you have made, access dates and times, the pages you've viewed or engaged with before or after using the Adstralia Platform, and other actions on the Adstralia Platform, including the pages or content you view and links you click to third-party applications. We may collect this information even if you haven't created an Adstralia account or logged in.

1.2.2 Device Information.

Such as IP address, hardware and software information, device information, device event information, unique identifiers, log information, and read receipts. We may collect this information even if you haven't created an Adstralia account or logged in.

1.2.3 Geolocation Information.

Such as precise or approximate location determined from your IP address, mobile or other device's GPS, or other information you share with us, depending on your device settings.

1.2.4 Cookies and Tracking Technologies.

Such as information collected through cookies, pixels, and similar technologies to help provide functionality, measure performance, detect fraud, and improve your experience.

1.3 Information We Collect from Third Parties.

We may collect information about you from other sources, such as:

1.3.1 Payment and Financial Providers.

When you use services like Stripe, we receive the information necessary to process payments, provide payouts, and issue receipts.

1.3.2 Third-Party Applications.

If you choose to link, or connect to the Adstralia Platform through a third-party service (e.g., Google), you authorize that service to share certain information with us, such as your registration details, profile information, and contacts, depending on your privacy settings.

1.3.3 Other Sources.

To the extent permitted by applicable law, we may receive additional information about you, such as demographic data, and information to help detect fraud and safety issues from (i) third-party service providers, other third parties, and/or partners, or (ii) Members and any other individuals, entities, and authorities, and combine it with information we have about you. For example, we may receive background check results or fraud warnings from identity verification service providers for use in our fraud prevention, security investigation, and risk assessment efforts. We may receive information about you and your activities on and off the Adstralia Platform, including from users of Adstralia, members of the public, governmental, public, or tax authorities, certain publicly-available information including social media posts or profiles, or about your experiences and interactions from our partners.

1.4 Special Considerations.

We may also collect information related to the content uploaded or shared on Adstralia:

1.4.1 Creative Work.

Creators may upload work that includes images, videos, or other media featuring people, locations, or brands. By submitting such content, you confirm you have the necessary rights and permissions to share it.

1.4.2 Third-Party Content and Links.

If you interact with third-party content or services linked from Adstralia, their own terms and privacy policies will apply. We are not responsible for how third parties handle your information.

2. How We Use Personal Information.

We use the information we collect to operate, provide, improve, and protect the Adstralia platform, as well as to comply with legal obligations.

2.1 Provide the Adstralia Platform.

We process your information to:

  • enable you to create an account and access the Adstralia Platform,
  • facilitate connections and transactions between Members,
  • enable you to upload, share, and manage Content,
  • process payments and issue receipts through Stripe,
  • provide customer support and respond to inquiries,
  • send you service-related notifications, security alerts, and account updates.

2.2 Improve and Develop the Adstralia Platform.

We process your information to:

  • perform analytics, debugging, and research,
  • monitor usage trends and improve functionality,
  • test and launch new features, and
  • train our team and systems to better serve our users.

2.3 Personalize Your Experience.

We process your information to:

  • personalize and customize your experience,
  • suggest Content, Creators, or content that may be relevant to you,
  • provide recommendations based on your activity and preferences.

2.4 Ensure Trust, Safety, and Compliance.

We process your information to:

  • detect, prevent, and address fraud, misuse, or illegal activities,
  • verify identities when necessary,
  • enforce our Terms of Service and other policies,
  • comply with applicable laws, regulations, and legal obligations,
  • investigate disputes or complaints.

2.5 Marketing and Communication.

We process your information to:

  • send you promotional or marketing communications (where permitted by law or with your consent),
  • administer referral programs, promotions, or surveys,
  • invite you to participate in events or opportunities.

You can opt out of marketing communications at any time.

2.6 Payments and Financial Services.

We process your information to:

  • process payments, payouts, and refunds,
  • verify payment information through Stripe,
  • detect and prevent financial fraud and security risks,
  • comply with anti-money laundering, tax, and accounting obligations.

2.7 Legal Bases for Processing (GDPR and EEA, Switzerland, and United Kingdom Users)

For users located in the European Economic Area, Switzerland, and the United Kingdom, we process personal information based on:

2.7.1 Contract.

Where processing is necessary to provide the Adstralia platform and fulfill our agreement with you.

2.7.2 Consent.

Where you have given clear consent (e.g., for marketing or cookies).

2.7.3 Legal Obligations.

Where processing is necessary to comply with laws (e.g., tax or anti-money laundering regulations).

2.7.4 Legitimate Interests.

Where processing is necessary for our business operations, provided your rights are not overridden (e.g., improving services, ensuring security).

3. How We Share the Information We Collect.

We only share personal information when necessary to operate the Adstralia Platform, comply with the law, or with your consent. We do not sell personal information to third parties.

3.1 Sharing With Your Consent or at Your Direction.

We share your information when you give consent or direct us to do so. For example, if you choose to connect Adstralia to a third-party application, we share information as authorized by you.

3.2 Who We Share With.

We may share your information with the following categories of recipients:

3.2.1 Other Users.

To enable campaigns, collaborations, or transactions, we may share relevant profile or content information between Members. This may include account names, creative content, and details necessary to facilitate the interaction.

3.2.2 Service Providers.

We use trusted third-party providers to help us operate Adstralia, including:

  • payment processors (such as Stripe),
  • cloud hosting and storage providers,
  • analytics and security providers,
  • customer support and communication tools.

These providers are contractually bound to protect your personal information and use it only for the services they perform for us.

3.2.3 Corporate Affiliates.

We may share information within the Adstralia corporate group (if applicable in the future) to provide technical infrastructure, improve our services, or for compliance purposes.

3.2.4 Business Transfers.

If Adstralia undergoes a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. If this happens, we will notify you before your information becomes subject to a different privacy policy.

3.3 Why We May Share Your Information.

3.3.1 Public Profiles and Content.

Some information you share on the Adstralia Platform may be visible to other users or the public. For example, Member profiles, creative portfolios, or Content may be accessible by others on or off the platform.

3.3.2 Legal Requirements and Safety.

We may disclose your information if required to do so by law, or if we believe in good faith that such disclosure is necessary to:

  • comply with legal obligations or valid legal requests (such as a court order),
  • protect our rights, safety, or property, or that of our users or the public,
  • prevent fraud, security risks, or other illegal activities,
  • respond to disputes or enforce our Terms of Service.
3.3.3 International Data Transfers.

If you are located in the European Economic Area, we may transfer your personal information to countries outside of the EEA. Where we do so, we rely on recognized safeguards such as the European Commission's Standard Contractual Clauses or equivalent protections under applicable law.

4. Payment Processing.

4.1 Provider.

All payments made on the Adstralia Platform are processed securely through Stripe, Inc. (“Stripe”). By using the Platform, you agree to be bound by Stripe's Terms of Service, available at https://stripe.com/legal. Adstralia is not a bank, money transmitter, or financial institution.

4.2 Transactions.

We act only as an intermediary between Members. Stripe provides Adstralia with access to limited payment information (such as receipts and payout reports), which is displayed within Member accounts.

4.3 Payouts.

Payouts to Creators are facilitated by Stripe's payout system. While Adstralia schedules payouts on a weekly basis, they remain subject to Stripe's schedules, fees, and requirements (including identity verification). Adstralia is not responsible for delays or failures in payout processing caused by Stripe.

4.4 Refunds and Chargebacks.

Refunds, cancellations, and transaction issues are governed by the Platform's Terms of Service. For privacy purposes, we note that:

  • Stripe processes refund and chargeback transactions on Adstralia's behalf.
  • Adstralia may receive related information from Stripe (such as chargeback notices or payment reversals).
  • Where applicable, Adstralia may deduct the refunded or charged-back amount (plus any fees imposed by Stripe) from a Member's balance or future payouts.

5. Your Choices and Rights.

You may exercise certain rights regarding your personal information, subject to applicable law.

5.1 Access and Correction.

You can access, review, and update some of your personal information directly through your Adstralia account settings. You are responsible for keeping your information accurate and up to date.

5.2 Deletion.

You may request the deletion of your personal information, subject to legal, regulatory, or legitimate business requirements that require us to retain certain data.

5.3 Objection and Restriction.

You may have the right to object to certain processing activities (such as direct marketing) or request that we restrict processing of your information in specific circumstances.

5.4 Portability.

Where applicable law provides, you may request a copy of your personal information in a portable format.

5.5 Regional Rights.

5.5.1 EU/EEA Residents (GDPR).

You have rights including access, correction, erasure, portability, objection, and restriction under the General Data Protection Regulation.

5.5.2 Brazil Residents (LGPD).

You have rights under the Brazil General Data Protection Law, including confirmation of processing, access, correction, anonymization, and portability.

6.1 Use of Cookies.

The Adstralia Platform uses cookies, pixel tags, and local storage to improve performance, support core functionality, analyze usage, and deliver relevant content and advertising.

6.2 Types of Cookies.

These may include:

6.2.1 Essential / Strictly Necessary Cookies.

Required for the operation of Adstralia. They support core features such as security, login, and customer support, and cannot be turned off.

6.2.2 Marketing Cookies.

Help us understand how people interact with our content, improve platform promotion, and limit the frequency of certain messages or promotions.

6.2.3 Personalization / Functionality Cookies.

Remember your preferences, such as language, currency, or past activity, to tailor your experience. For example, they allow us to highlight content based on what you've viewed before.

6.2.4 Analytics / Performance Cookies.

Help us understand user behavior on the Platform, measure performance, and fix issues. These do not include essential cookies.

6.3 User Control.

Users can manage or disable non-essential cookies through their browser settings or through the Platform’s cookie preferences interface. Disabling certain cookies may affect the functionality of the Platform.

6.4 Third-Party Cookies.

Some cookies may be set by trusted third-party service providers, such as analytics or advertising partners. These parties may collect information about users' activities over time and across different websites.

6.5 Consent.

Where required by law, users will be asked to provide consent before non-essential cookies are set on their device. Users can update their preferences at any time.

7. Data Retention.

7.1 Retention Periods.

We retain personal information for as long as necessary to provide, maintain, and improve the Adstralia Platform, and to fulfill the purposes outlined in this Privacy Policy, consistent with applicable law. Factors considered when determining retention periods include:

  • The length of time you maintain an active Adstralia account or use the Adstralia Platform, and the time thereafter during which we may have a legitimate need to retain information, such as to manage and protect the business, address disputes, or defend claims.
  • Legal, tax, reporting, or auditing obligations that require us to retain certain records, including transaction and payment history.
  • Our legitimate interest in protecting the safety, security, or legal rights of Adstralia, its users, or the public, including retention required by statutes of limitations, litigation, or regulatory investigations.

7.2 Shared Content and Public Information.

Information you share with other users, such as collaboration content, or profiles, may remain visible to others even after your account is deactivated or deleted.

7.3 Residual Copies.

Despite our efforts to delete personal information upon request or when no longer needed, residual copies may remain in backup systems or archives for a limited period of time to ensure business continuity and protect against data loss.

8. Data Security.

While no platform can guarantee perfect security, Adstralia implements and continuously updates administrative, technical, and physical measures to help protect your personal information against unauthorized access, loss, destruction, or alteration.

Members are responsible for keeping their account credentials, passwords, and devices secure. You should avoid sharing your login information and notify us immediately if you suspect any unauthorized access to your account.

9. International Transfers.

Adstralia is based in Portugal, and your personal information may be stored and processed in countries outside your country of residence. These countries may have different data protection laws than those in your home country.

When transferring your personal information internationally, we rely on recognized safeguards, such as:

  • Standard Contractual Clauses approved by the European Commission,
  • Adequacy decisions issued by relevant authorities, or
  • Other legal mechanisms permitted under applicable data protection laws.

By using the Adstralia Platform, you consent to the transfer of your information to countries outside your country of residence, including countries that may not provide the same level of data protection. We take steps to ensure your personal information remains protected consistent with this Privacy Policy.

10. Children's Privacy.

The Adstralia Platform is intended for individuals 18 years of age or older. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected personal information from someone under 18, we will take steps to delete such information promptly.

11. Changes to This Privacy Policy.

We may update this Privacy Policy from time to time to reflect changes to our practices, legal requirements, or the Adstralia Platform. When we do, we will post the updated Privacy Policy and revise the “Last Updated” date at the top.

For material changes, we may provide notice, for example, via email or a platform notification, in advance of the changes taking effect. If you do not agree with the updated Privacy Policy, you should stop using the Adstralia Platform. Your continued use of the Platform after the updated Privacy Policy becomes effective constitutes your acceptance of the revised terms.
